These Terms of Service (“Agreement”) govern your use of the Kelas Maya by Aceture Network (SSM Reg No: 201903195965) website and services (collectively referred to as the “Website” and “Services”). By accessing or using the Website, you (“you” or “user”) agree to comply with and be bound by this Agreement.

1. Services Description

1.1. Kelas Maya provides an eLearning platform designed for primary students to prepare for examinations. Our services include access to a Learning Management System (LMS) and a Learning Bot.

1.2. Additional features and tools may be added to enhance the educational experience. These features will be governed by this Agreement.

2. User Account Creation

2.1. To access the courses, users must create an account by providing the required information and completing the payment process. Access to courses is granted only after payment confirmation.

2.2. Users are responsible for maintaining the confidentiality of their login credentials and for all activities that occur under their account.

3. User Obligations

3.1. Users must not misuse the service, violate any applicable laws, or engage in any behavior that disrupts the operation of the Website or Services.

3.2. Users are prohibited from sharing their account credentials with others or allowing others to access their account. Accounts are for individual use only.

3.3. Users agree to comply with all rules, guidelines, and policies established by Kelas Maya, including but not limited to those related to acceptable and prohibited behavior on the platform.

4. Intellectual Property Rights

4.1. All content provided on the Website, including course materials and platform tools, is the property of Kelas Maya or its licensors.

4.2. All user-generated content, including student answers and assignments, becomes the property of Kelas Maya upon submission. Kelas Maya reserves the right to use, reproduce, modify, and display such content freely for any purpose, including research and educational use, while ensuring that user anonymity is maintained.

5. Limitation of Liability

5.1. Kelas Maya is not responsible for any loss, damages, or liabilities arising from your use of the Website or Services. This includes, but is not limited to, any direct, indirect, incidental, or consequential damages.

5.2. The Website and Services are provided on an “as is” basis, without any warranties or guarantees of any kind, either express or implied.

6. Termination Clauses

6.1. Kelas Maya reserves the right to terminate any user account at its discretion, particularly in cases of misuse, account sharing, or any other violations of this Agreement.

6.2. Termination of an account may occur without prior notice, and no refunds will be provided in such cases.

7. Dispute Resolution

7.1. In the event of any disputes arising out of or related to this Agreement, users agree to first attempt to resolve the issue informally by contacting Kelas Maya customer service.

7.2. If a dispute cannot be resolved informally, it will be submitted to binding arbitration under the rules of the Malaysian Arbitration Association. The arbitration shall be conducted in Malaysia, and the decision of the arbitrator shall be final and binding.

8. Governing Law

8.1. This Agreement shall be governed by and construed in accordance with the laws of Malaysia.

9. Changes to Terms

9.1. Kelas Maya reserves the right to change these Terms of Service at any time without prior notice. Any changes will be effective immediately upon posting on the Website.

10. Other Concerns

10.1. Refunds are not available under any circumstances.

10.2. We may use collected data for academic research, publication in conferences, academic journals, competitions, or other academic programs, ensuring all data is anonymized to protect user privacy.
